  • The recipient is unavailable;

9. Delivery Risk

9.1 For Consumer purchases, risk transfers in accordance with applicable New Zealand law.

9.2 For Business Customers, risk passes upon delivery to the nominated delivery address unless otherwise agreed in writing.

9.3 Customers should inspect deliveries promptly upon receipt.

9.4 Customers should not accept packages showing evidence of:

  • Leakage;
  • Significant damage;
  • Tampering; or
  • Unsafe conditions,

without documenting the issue and notifying Clariq as soon as reasonably practicable.


10. Tracking

10.1 Where tracking services are available, tracking information will generally be provided following dispatch.

10.2 Tracking information is supplied for convenience only.

10.3 Carrier tracking systems are managed by third parties and Clariq is not responsible for:

  • Tracking outages;
  • Tracking inaccuracies; or
  • Carrier system failures.

11. Failed Deliveries

11.1 Additional freight charges may apply where delivery cannot be completed because:

  • Incorrect delivery information was supplied;
  • Delivery was refused;
  • No authorised recipient was available;
  • Access restrictions prevent delivery; or
  • Repeated delivery attempts are required.

11.2 Where a shipment is returned to Clariq due to customer error or non-acceptance, Clariq may charge:

  • Re-delivery costs;
  • Return freight costs;
  • Handling fees; and
  • Storage costs where reasonable.

11.3 Clariq may cancel an order where delivery repeatedly cannot be completed.


12. Delays Beyond Clariq's Control

12.1 Clariq shall not be responsible for delivery delays resulting from circumstances beyond its reasonable control, including:

  • Weather events;
  • Natural disasters;
  • Transport disruptions;
  • Freight network congestion;
  • Industrial action;
  • Customs or regulatory actions;
  • Government restrictions;
  • Supply chain disruptions;
  • Carrier delays; or
  • Force majeure events.

12.2 Delivery estimates are automatically extended by the duration of any such event.


13. Damaged, Lost or Missing Deliveries

13.1 Customers must notify Clariq as soon as reasonably practicable if:

  • Goods arrive damaged;
  • Goods arrive leaking;
  • Goods appear unsafe;
  • Goods are missing; or
  • The shipment appears incomplete.

13.2 Customers should retain:

  • Packaging;
  • Product labels;
  • Freight documentation; and
  • Photographic evidence

until Clariq advises otherwise.

13.3 Clariq may investigate claims with carriers before determining the appropriate remedy.

13.4 Nothing in this clause limits any rights available under applicable New Zealand consumer law.


14. Authority to Leave

14.1 Authority-to-leave deliveries may be offered at the discretion of the carrier.

14.2 Customers requesting authority-to-leave acknowledge that delivery may occur without a signature.

14.3 Authority-to-leave instructions may not be available for:

  • Dangerous goods;
  • Hazardous substances;
  • Restricted products; or
  • Higher-value consignments.

14.4 Clariq reserves the right to require signature-on-delivery services where appropriate.


15. Export and International Deliveries

15.1 Clariq products, labels, SDS documentation, and technical information are primarily prepared for New Zealand use.

15.2 Where Clariq agrees to export products:

  • Additional compliance requirements may apply;
  • International restrictions may apply;
  • Additional freight charges may apply; and
  • Customers are responsible for complying with local laws and import requirements.

15.3 Clariq may refuse export requests at its discretion.
